Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the eo.tc subdomain registration service (the "Service") operated by Elysia Root L.C. ("we", "us", or "Operator"). By creating an account, registering a subdomain, or otherwise using the Service, you (the "Registrant" or "User") agree to these Terms. eo.tc is operated as a subdomain registry under the .tc top-level domain. We are not an ICANN-accredited registrar; however, where reasonable, the policies below mirror the substance of ICANN's Registrar Accreditation Agreement ("RAA"), the Uniform Domain-Name Dispute-Resolution Policy ("UDRP"), and the Transfer Policy, adapted to a subdomain context.
1. Definitions
- Subdomain — a name registered under
eo.tc(e.g.example.eo.tc). - Registrant — the natural person or legal entity in whose name a Subdomain is registered.
- Account holder — the user with login credentials to administer one or more Subdomains.
- Operator — Elysia Root L.C., the operator of the Service.
- WHOIS — the public lookup interface (web and port-43 protocol) showing registration information for a Subdomain.
- Service — the website, API, WHOIS server, and DNS infrastructure operated under eo.tc.
2. Acceptance; Eligibility
By using the Service you represent that you (i) are at least 13 years old, (ii) have legal capacity to enter into these Terms in your jurisdiction, and (iii) are not barred from using the Service under applicable U.S. or other law. If you act on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for the security of your account credentials and for all activity under your account.
3. Acceptable Use Policy (AUP)
You agree not to use the Service to host, distribute, or otherwise enable any of the following:
- Phishing, credential harvesting, or impersonation of others
- Malware, ransomware, exploit kits, or other malicious software
- Unsolicited bulk messaging (spam) or fraud
- Content that is illegal under applicable U.S. federal or state law
- Infringement of intellectual-property or privacy rights of third parties
- Sign-up using disposable, temporary, or burner email services
Use of disposable/temporary email services results in immediate, no-notice account suspension and deletion of all Subdomains registered through that account. This is non-negotiable: by creating an account you waive any right to dispute, appeal, question, or seek compensation for such enforcement actions.
Operator discretion. In addition to the specific categories above, we may suspend, terminate, or refuse service to any account, Subdomain, or DNS record that, in our sole judgment, appears abusive, deceptive, automated at scale, commercially undesirable, or otherwise inconsistent with the spirit of the Service — even where no specific rule has been violated. By using the Service you accept that operator discretion is final.
We may suspend or terminate any Subdomain or account that violates this AUP without prior notice. Reports of suspected abuse may be sent to abuse@elysia-root.com; we review reports within 24–72 hours and reserve the right to investigate without further notice.
4. Plans and Lifecycle
4.1 Free plan
Free Subdomains do not have a fixed expiration date. We may, at our discretion, place new free registrations in a manual review queue for spam or abuse prevention. We may also require the Registrant to confirm the registration by clicking a verification link sent to the Registrant email address (see Section 7). If the Registrant does not confirm within the verification window, the registration is cancelled and the name is released for re-registration.
4.2 Sponsorship plan ($2)
Sponsorship Subdomains activate immediately upon successful payment and successful Registrant email verification, and do not have a fixed expiration date. Payment is a one-time charge described in Section 5.
4.3 Voluntary cancellation
A Registrant may cancel a Subdomain from the dashboard. Cancellation begins a 90-day grace period during which the Subdomain is suspended but the original Registrant may recover it. At the end of the grace period the Subdomain is deleted; free Subdomains then enter a 30-day cooldown during which no party may re-register the same name.
5. Payments and Refunds
Payments are processed by Stripe. By providing payment details you authorize the corresponding charge under the plan you selected. Paid registrations may be refunded within 7 days of the charge upon written request, less any processing fees retained by Stripe.
Voluntary cancellation does not entitle you to a refund. If you delete or cancel a sponsorship Subdomain after the 7-day refund window, no refund is provided.
6. Registrant Information & Accuracy
At registration you must provide accurate, current, and complete Registrant contact information, including:
- Registrant name (Latin characters)
- Registrant email address (must be controlled by the Registrant)
- Registrant phone number in international format (e.g.
+1 555-0123) - Registrant country (ISO country code)
You agree to keep this information accurate and current at all times. You may update it from your dashboard; material updates may require email verification of the change. You may enable WHOIS Privacy from your dashboard to mask the Registrant name and country in public WHOIS responses; other operational fields (creation date, last update, name servers, FQDN) remain public.
Providing false, misleading, or wilfully inaccurate Registrant information, or failing to respond to a reasonable verification request, is a material breach of these Terms and is grounds for suspension or cancellation of the Subdomain without notice. This requirement is modeled on ICANN's WHOIS-accuracy obligations even though we are not an ICANN-accredited registrar.
7. Registrant Email Verification
Upon registration we send a verification link to the Registrant email address. The Registrant must click the link within 15 days to confirm the registration. Until the link is clicked the Subdomain remains in a pending state and does not resolve through our managed DNS. If the link is not clicked within the verification window, the registration is cancelled and the name is released. This step parallels ICANN's RAA Section 3.7.8 post-registration verification practice.
8. Registrant Rights and Responsibilities
Modeled on ICANN's Registrants' Benefits and Responsibilities document, the Registrant has the following rights with respect to a Subdomain registered through the Service:
- The right to receive a copy of the Registrant information on file and to request correction of inaccuracies.
- The right to transfer the Subdomain to another account on the Service, subject to Section 10 (Transfer).
- The right to control the DNS settings of the Subdomain (Managed mode) or to delegate to external name servers (Delegated mode).
- The right to be notified by email of material changes affecting the Subdomain (e.g. successful transfer, suspension, planned cancellation).
- The right to recover a cancelled Subdomain during the grace period described in Section 4.3.
- The right to enable WHOIS Privacy without additional charge.
The Registrant has the following responsibilities:
- To keep Registrant contact information accurate and current.
- To maintain the security of the email account used as the Registrant email; loss of access to that mailbox may permanently prevent recovery or transfer of the Subdomain.
- To respond promptly to communications from us about the Subdomain, including abuse inquiries, verification requests, and security notices.
- To comply with the AUP in Section 3 and all applicable law.
9. Dispute Resolution Policy for Subdomain Names
Subdomains registered through the Service are subject to a dispute resolution policy modeled on ICANN's UDRP. A complainant who alleges that (i) a Subdomain is identical or confusingly similar to a trademark or service mark in which the complainant has rights, (ii) the Registrant has no legitimate interests in the Subdomain, and (iii) the Subdomain was registered and is being used in bad faith, may send a complaint to abuse@elysia-root.com. We will review the complaint, give the Registrant a reasonable opportunity to respond, and may suspend or transfer the Subdomain to the complainant if all three elements are established. Our determination is internal and final; it is not a substitute for a court proceeding, and either party may pursue judicial remedies independently. Where the complaint is plainly frivolous we may dismiss it without further review.
10. Transfer of Subdomain Ownership
A Registrant may transfer a Subdomain to another account on the Service from the dashboard. The current Registrant initiates the transfer by entering the recipient's email; both parties must confirm via email links within 72 hours. After successful confirmation, ownership transfers immediately and the recipient becomes the new Registrant. The transferring Registrant may cancel the request at any time before the recipient confirms. Transfers do not refresh expiration timers (Subdomains under the current model have no expiration) and do not change the DNS records or operation mode of the Subdomain.
We may decline or reverse a transfer if it appears to be the product of fraud, unauthorized access, or AUP violation.
11. DNS Operation Modes
Each Subdomain operates in one of two modes:
- Managed — DNS records (A, AAAA, CNAME, NS, SRV, TXT, MX) are managed through our console using the Cloudflare DNS infrastructure.
- Delegated — Up to ten of your own name servers are published as NS records for the Subdomain. You operate the authoritative DNS service for the name.
You may switch modes at any time while the Subdomain is active. DNS-cache propagation may take up to the configured TTL.
12. Future TLD Reselling Notice
The Service currently provides registration of Subdomains under eo.tc. We may, in the future and after separate notice, offer reseller-style registration of generic top-level domains (gTLDs) such as .com or .net. If such service is added, additional policies will apply, including the ICANN Registrar Accreditation Agreement (RAA), the Uniform Domain-Name Dispute-Resolution Policy (UDRP), the Transfer Policy, ICANN WHOIS-accuracy obligations, and TLD-specific terms. Refund, renewal, and transfer rules may differ for gTLD products.
13. Suspension and Termination
We may suspend or terminate access to any Subdomain or account if we believe, in good faith, that (i) the AUP has been violated, (ii) Registrant information is materially inaccurate, (iii) payment has failed or been reversed, (iv) the Subdomain is the subject of a credible legal or dispute claim, or (v) applicable law requires us to do so. Termination does not entitle you to a refund except where expressly stated in Section 5.
14. Service Discontinuation
The Service may be discontinued at any time. Although Subdomains registered through the Service do not have a fixed expiration date, the Service itself may be modified, paused, or fully discontinued at any time and for any reason — including but not limited to operational, financial, legal, or strategic reasons. We will make reasonable efforts to give advance notice when feasible, but are not obligated to do so. By creating an account or registering a Subdomain, you acknowledge and agree to this possibility, waive any claim arising from such discontinuation, and accept that prior payments (including the $2 sponsorship) are non-refundable in the event of discontinuation.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ELYSIA ROOT L.C. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIVE U.S. DOLLARS.
17. Indemnification
You agree to indemnify and hold harmless Elysia Root L.C. and its officers, employees, and agents from any claims, losses, or damages, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Service.
18. Governing Law
These Terms are governed by the laws of the State of Wyoming, U.S.A., without regard to its conflict-of-law principles. The federal and state courts located in Wyoming will have exclusive jurisdiction over any disputes not subject to arbitration.
19. Dispute Resolution; Arbitration (between You and Operator)
Any dispute arising under these Terms (other than a Subdomain-name dispute governed by Section 9) will, at the election of either party, be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You and Elysia Root L.C. each waive the right to a trial by jury and the right to participate in a class action. Notwithstanding the foregoing, either party may seek injunctive relief in court for intellectual-property or AUP violations.
20. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or on the Service at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
